Terms and Conditions
Definitions
| “Child” | means a UK resident who is under 16 and is the beneficiary of the Swim Subscription/Qualifying Swim Subscription and who will participate in the swim lessons under the Swim Subscription/Qualifying Swim Subscription purchased by the Parent/Guardian; |
| “Offer Period” | the Offer runs from 5 March 2026 until 31 March 2026. Referrals must be submitted and the Referee must complete their Qualifying Swim Subscription purchase within this period for the Referrer and Referee to qualify for the Offer; |
| “Parent/Guardian” | means an individual aged 18 or over who is a UK resident and who is acting on behalf of a Child and: (a) in respect of all Participating Clubs other than Fulham, holds an active Virgin Active membership in the UK; or (b) in respect of the Fulham club only, is not required to hold a Virgin Active membership, and who agrees to be bound by these Terms and Conditions; |
| “Participating Clubs” | Bromley, Chelmsford, Chiswick Riverside, Clapham, Clearview, Crouch End, Fulham, Islington Angel, Kensington, Mill Hill, Northampton Collingtree Park, Northampton Riverside Park, Notting Hill, Nottingham, Salford Quays, Sheffield, Solihull,, Thundersley, Wandsworth and Wimbledon. For the avoidance of doubt, Swiss Cottage club may participate in this Offer only in relation to 3-month swim subscriptions, as this club is scheduled to close and does not offer longer‑term membership options; |
| “Promoter” | means Virgin Active Limited whose registered office address is at 26 Trinity Lane, Mansion House London, EC4V 2AR (company no. 03448441); |
| “Referee” | means a new customer (being a Parent/Guardian) who, as a result of a referral made under the Offer, enters into a Qualifying Swim Subscription for their Child; |
| “Referral Process” | as set out at clause 3 below; |
| “Referrer” | means a Parent/Guardian who holds an active Swim Subscription for a Child and who makes a referral under the Offer; |
| “Swim Subscription” | means the paid 12-month subscription already purchased by a Parent/Guardian that provides a Child with access to swim lessons offered by the Club; |
| “Qualifying Swim Subscription” | means a 12-month group swim subscription from the Promoter for group lessons paid for by the Referee, to be attended by the Child; Excluded swim subscriptions: · all three (3) month subscriptions; · all 1-2-1 and 2-2-1 classes; · adult swim packs. For the avoidance of doubt, additional exclusions and eligibility criteria may apply and will be communicated at the Participating Clubs, via the app, and/or at the point of purchase. In the event of any inconsistency, these Terms and Conditions shall prevail |
Key Terms
- If the Referrer refers the Referee to purchase a Qualifying Swim Subscription, the Referrer and Referee will each be entitled to 50% off one (1) month of their respective swim subscription fee once the Referee has made two (2) full price direct debit payments in respect of their Qualifying Swim Subscription. The 50% discount will be applied automatically to the next monthly direct debit payment following receipt of the Referee’s second successful full-price direct debit payment, provided all eligibility criteria continue to be met at that time. The 50% discount applies to the standard monthly subscription fee only and excludes any additional products, add-ons, coaching upgrades, court bookings, or ancillary charges. No cash alternative is available.
- For the Referrer and the Referee to be eligible for the Offer, the Referral Process (as set out below) must be completed before the Referee completes their Qualifying Swim Subscription purchase (including, but not limited to, the Referee agreeing to the direct debit and paying any other upfront payments required to be made).
- To complete the Referral Process:
(a) the Referee must scan the ‘Refer a Friend’ QR code found in the Promoter’s marketing materials and complete the associated form with their contact data, which will then be sent to the relevant Participating Club;
(b) the Participating Club will then contact the Referee, using contact details provided in the contact form to confirm the Referrer’s details;
(c) once the Referrer has been verified to meet the eligibility criteria set out above, the Referee will be eligible to enrol their Child onto a Qualifying Swim Subscription under the Offer, subject to the other eligibility requirements and exclusions set out herein;
(d) the Referee must then make two (2) successful direct debit payments for their Qualifying Swim Subscription for both the Referee and the Referrer to be eligible to redeem the Offer.
- The Offer does not apply if:
(a) the Referee has any active or frozen swim subscription at the time the Referral Process is completed, or has held any swim subscription at any time after the 31 January 2026;
(b) the Referrer is in arrears of either their Swim Subscription and/or their Virgin Active membership;
(c) the Referee does not set up and maintain the Qualifying Swim Subscription monthly direct debit payments, or any direct debit payment related to their membership fails, or is refunded in accordance with the Qualifying Swim Subscription’s terms and conditions;
(d) the Referee cancels, terminates, or otherwise ends the Qualifying Swim Subscription direct debit or their Virgin Active membership before making two (2) full price direct debit payments; or
(e) the Referral Process is incomplete or cannot be validated (including, but not limited to, where details provided by the Referrer and/or Referee are inaccurate or incomplete).
- A Referrer may refer multiple Referees and will receive 50% off one (1) month of their swim subscription fee for each Referee who goes on to purchase a Qualifying Swim Subscription in accordance with these Terms and Conditions. For example, if a Referrer refers six (6) friends in accordance with these Terms and Conditions, the Referrer will receive six (6) months of their Swim Subscription fee at 50% off.
- Where a Parent/Guardian has more than one Child, the Referral Process may be used separately in respect of each Child. A separate referral submission (via the QR code and associated form) must be completed for each Child being referred under this Offer. Each Child who successfully enrols onto a Qualifying Swim Subscription in accordance with these Terms and Conditions shall constitute a separate referral for the purposes of this Offer.
Accordingly:
(a) each successfully referred Child will receive 50% off one (1) month of their Qualifying Swim Subscription; and
(b) the Referrer will receive 50% off one (1) month of their Swim Subscription for each successful referral.
By way of example, if a Referrer successfully refers three (3) Children who each enrol onto a Qualifying Swim Subscription and meet all eligibility requirements, each of those three Children will receive 50% off one (1) month of their subscription, and the Referrer will receive 50% off three (3) separate months of their Swim Subscription. - The swim lessons included as part of the Swim Subscription/Qualifying Swim Subscription:
(a) are provided to the Referrer and Referee only and are not transferable, not for resale and cannot be exchanged for cash or credit;
(b) are standard junior swim group lessons, as offered at the applicable Participating Clubs (session length and format as determined by Virgin Active);
(c) are subject to swim programme availability and normal booking rules; and
(d) must be used within the period specified in the terms and conditions applicable to the relevant Swim Subscription or Qualifying Swim Subscription (as applicable) (and if no period is stated, within 3 months of being applied). - The Offer cannot be used in conjunction with any other offer or discount relating to swim lessons and/or subscriptions, unless the Promoter states otherwise in writing.
- The Offer is subject to availability and may be withdrawn by the Promoter at any time.
- The Promoter reserves the right to amend these Terms and Conditions and the Offer at any time without notice, including in the event of fraudulent behaviour or misuse.
- If a 50% discounted month has been applied and it is later found that the eligibility requirements for this offer were not met, the Promoter reserves the right to remove the discount or charge the customer for the discounted value already received.
- The Promoter is not liable for the reproduction of this Offer or any indirect access via third party websites or otherwise and where such reproduction misstates or omits any of the information or Terms and Conditions connected with this Offer it shall not be valid. This Offer may only be offered to you by the Promoter.
- Nothing in these Terms and Conditions shall be deemed to exclude or restrict any of the eligible persons’ statutory rights as a consumer. Details are accurate at time of writing.
- This Offer and its Terms and Conditions are governed by English law and is subject to the exclusive jurisdiction of the English Courts.
